Welcome to Art From The Heart, the online gallery of Tanya Moiseev. By accessing this website or purchasing artwork offered through it, you agree to the following Terms and Conditions.
1. Original Artwork
Unless specifically identified otherwise, artwork offered for sale through Art From The Heart is original artwork created by Tanya Moiseev. Original artwork is handmade and may contain variations in texture, brushwork, surface appearance, materials, and other characteristics inherent to the artistic process. These characteristics are part of the artwork and are not considered defects.
2. Artwork Images and Colors
Every reasonable effort is made to represent each artwork accurately through photographs and descriptions. Colors and appearance may vary somewhat from the original because of computer monitors, mobile screens, display settings, lighting conditions, and photography. Such reasonable variations are not considered defects.
3. Pricing and Payment
Unless otherwise stated, all prices are listed in U.S. Dollars. Full payment is required before artwork is shipped.
Art From The Heart reserves the right to correct pricing or listing errors, refuse transactions reasonably believed to be fraudulent or suspicious, and cancel orders that cannot be fulfilled. If an order is canceled after payment has been received, the amount paid for the canceled order will be refunded.
4. Availability
Original artworks are unique items and generally available only once. Although reasonable efforts are made to keep availability information current, an artwork shown as available may occasionally have already been sold or otherwise become unavailable. If payment is received for an artwork that is no longer available, the payment will be refunded.
5. Shipping and Delivery
Shipping, delivery, damage claims, and returns are governed by the separate Shipping & Returns Policy.
6. Copyright and Intellectual Property
All artwork displayed on this website remains the intellectual property of Tanya Moiseev unless expressly stated otherwise. Purchasing an original artwork transfers ownership of the physical artwork only. It does not transfer copyright, reproduction rights, distribution rights, licensing rights, or commercial usage rights.
Artwork and images appearing on this website may not be reproduced, copied, scanned, published, distributed, sold as prints or merchandise, or used commercially without prior written permission from Tanya Moiseev.
7. Website Content
Photographs, artwork images, written descriptions, graphics, and other original content appearing on Art From The Heart may not be reproduced or commercially used without permission.
8. Limitation of Liability
To the maximum extent permitted by applicable law, liability arising from the purchase of artwork shall not exceed the amount actually paid for that artwork. Tanya Moiseev and Art From The Heart shall not be liable for indirect, incidental, consequential, or special damages arising from the purchase, possession, display, or use of artwork.
Nothing in these Terms is intended to exclude or limit rights or remedies that cannot legally be excluded or limited.
9. Governing Law
These Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes arising from these Terms shall, where legally permitted, be resolved in the courts located in Flagler County, Florida.
10. Changes to These Terms
These Terms may be updated periodically. The current version and its effective date will be posted on this page.
